The economic court of Kiev on 15 August ordered the state enterprise Boryspil international airport to hold a new tender to lease space in terminal D. it is reported by the press service of the Antimonopoly Committee of Ukraine.
“The economic court 2 and 15 August 2016 upheld the decision of administrative Board of the Kyiv regional territorial office of AMKU on April 14, 2016 No. 19 and No. 20 on the abuse of the SE ia Boryspil monopoly position and its joint anticompetitive concerted actions with Aerohandling”, – is told in the message of the AMC.
Board territorial office acknowledged that MA Boryspil has a monopoly position in the market parts of the premises.
It is also noted that the requirements to the conditions of a tender for the right to lease part of the area of the passenger terminal D with an area of 157,5 sq. m. was discriminatory, so winning the contest was won by the company Aerohandling.
The Board also recognized the actions of the international airport and Aerohandling anticompetitive concerted, that is, those which significantly limit the competitiveness of other economic entities on the market.
It is noted that ” MA ” Borispol and Aerohandling Board imposed fines for a total amount of 194 thousand UAH and obliged the airport to conduct a new competition that will meet the requirements of the legislation on protection of economic competition.
Entities have exercised their right and appealed against the decision in court. However, the Economic court of Kiev took the side of the competition authority and dismissed the claims.
