The Ministry of justice of Ukraine introduced a mechanism for automatic data exchange between the registry of property rights and Gosgeokadastr. It will prevent double registration of land lease agreements, as the Registrar is not physically able to do so, said the Deputy Minister of justice for the state registration of Elena Sukmanova.
“One of the main causes of conflicts in the agrarian sector the existence of dual land lease agreements. A situation where two tenants assert their rights to the same plot and both show the documents to him, unfortunately, not uncommon”, – quotes Sukmanova the press service of the Ministry of justice.
According to the Deputy Minister, before you make any lease of land, the Registrar must be satisfied that the lease land was not registered in the Department of land resources, which until 2013 was recorded in the relevant treaties.
“To check the Registrar must refer the request to the Gosgeokadastr and get a reply that the plot is not rented, scan it and submit to the registry. But in practice, the Registrar or submit a request, or not waiting for a response, and then don’t know what the answer should be given, and re-register a lease of land that is already leased,” said she. As a consequence, the same unit appear tenants, often by force, with the involvement of security firms begin to decide who has the right to cultivate the land and collect the crops.
“To solve this problem, we introduced on a technical level, the automatic exchange of data between our register of property rights and Gosgeokadastr. Now the logger is physically unable to complete the procedure of entering data and close the key in the registry, while is not automatically “pull” the data from Gosgeokadastra the presence or absence of registration of the land plot”, – said Sukmanova.
According to her, the automatic data exchange between registries would reduce the opportunity for hostile takeovers, because it is a dual lease agreements are often used by raiders as a tool to launch attacks on farms.
