The appeals court of Kirovograd region has put an end to the legal fees between Oschadbank and former owners of PJSC Creative.

As reports a press-service of the savings Bank, the court upheld the decision of the Kirov district court of Kirovograd, which is in favor of the Bank with Maxim Berezkin and Yuri Davydov, which are the guarantors of the obligations of PJSC Creative, collect the debts in the sum more than $180 million, 12 million and € 117 million UAH.

In addition, Davydova for filing the appeal was charged to the state budget of 83 million UAH, court fee, payment of which was previously deferred.

“The Bank in the court of appeal upheld the decision of the court of first instance, despite the efforts of defendants to avoid responsibility,” – said in Oshchadbank.

The Bank stressed that, despite the attempts of defendants to recognize their obligations under the bail dismissed, the court of first instance, which was agreed to and the court of appeal, adhering to a legitimate and coherent position, took the side of the Bank and refused in satisfaction of the counterclaim.

After the appeal the decision of the court of first instance came into legal force and will be referred to enforcement.

The share of loans to PJSC Creative in the state-owned banks as of the end of March 2015 was about 80%, or more than 11.3 billion UAH. The main part of the debt owed to Oschadbank (of 6.73 billion UAH), Ukrgasbank (UAH 2.04 billion), Ukreximbank (UAH 2.54 billion). Creditors also have the Landesbank Berlin, UniCredit Bank (Germany), UniCredit Bank (Czech Republic), Raiffeisen Bank (Czech Republic), Ukrsotsbank and others.

In August 2016, the Kirov district court of Kirovograd has satisfied the claim of the Bank to the former top-managers and owners of the company Kreativ Maxim Berezkin and Yuri Davydov, which are the guarantors of the debts of the company, in the amount of more than $180 million, 12 million and 117 million UAH.

In may 2016 Oschadbank won a court Berezkin in the amount of $25 million was seized all the property of Maxim Berezkin and started the enforcement.
