Press Secretary of the Ministry of foreign Affairs of Ukraine Marian Betz reported that Ukraine had still not filed a lawsuit at the international court of justice. She recalled that Ukraine was once a defendant in the case of Romania against the Ukrainian state.
“We never initiated (the case – ed) I am more than convinced that Russia didn’t expect Ukraine really will file a lawsuit in the international court of justice – the highest court,” said Betz in the air Sedanca z 1+1.
Press Secretary of the foreign Ministry also explained why the claim on the Crimea was not served previously. “There was no delay. It was very important to determine which conventions apply to Russia, where Russia recognizes the jurisdiction of the international court of justice. Because in most cases, and it still stretches from the time of the USSR, Russia does not recognize the compulsory jurisdiction”, she said.
Ukraine takes action on the basis of the Convention for the suppression of the financing of terrorism and the Convention, which deals with the combating of all forms of racial discrimination. “Before sue to the court, these conventions provide for a procedure of pre-trial settlement. That is, it was necessary to hold consultations with Russia,” said Betz.
She also noted that in fact for failure to comply with the procedural elements of such a claim against Russia lost Georgia.
In addition, said press Secretary of the Ministry of foreign Affairs, Ukraine qualitatively prepared for the necessary claim documents.
“Today’s hearing in essence, and in precautionary measures required by Ukraine from Russia. They focus on ensuring that the court made an immediate decision that must be protected civilian population”, – said Betz.
The decision should be made in a month or two and it is binding on the parties, she added. The foreign Ministry also commented on the possible ignoring of the Russian court decision of the United Nations.
“Russia has violated international law: it grossly violated the UN Charter. The risk is that Russia may not execute the court decision,” said Betz.
