The high Council of justice adopted changes to the Rules that allow you to immediately consider the idea of giving consent to the judge’s detention or arrest. This is stated in the message of VSP.

“In order to comply with constitutional guarantees of independence and immunity of judges, prosecutors, in accordance with article 131 of the Constitution of Ukraine, article 3 of the law of Ukraine on the High Council of justice, clause 24.6 of the Rules of the High Council of justice, Chairman of the Supreme Council of justice Igor Benedick at the meeting on 7 February 2017 announced the court’s decision on amending Chapter 18 of the Rules of “Giving consent to the arrest of a judge, his detention or arrest”, – stated in the message.

According to the decision, the idea of granting consent to detention judge, his detention or arrest is considered by the Council no later than five days from the date of its receipt.

The idea of giving consent to detention or arrest, against a judge who is apprehended during or immediately after committing a serious or especially serious crime, is considered without delay after the receipt of the submission within the terms stipulated by the Criminal procedural code of Ukraine.

“Today the High Council of justice adopted amendments to the Regulations for granting approval of the content of the judge’s detention or arrest. The General Prosecutor’s office, Specialized anti-corruption prosecution to provide consent to the election of a preventive measure related to deprivation of liberty, the Council will consider immediately,” said the Chairman of the High Council of justice Igor Benedick.

According to Benedicta, these changes in the Regulations of the Council allow the court, for its part, to consider this question within the period stipulated by the Criminal procedural code of Ukraine, that is within 72 hours from the moment of detention of a person.

He added that if necessary, meetings of the Supreme Council of justice will be conducted in weekends or holidays.

Later in the NEB denied the necessity of permission of the High Council of justice on the detention of judges.
